1. Acceptance of Terms

Welcome to AI Make Food ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the AI Make Food website at aimakefood.com (the "Website"), our mobile applications for iOS and Android (the "Mobile Apps"), and all related services, features, and content (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

AI Make Food is an artificial intelligence-powered cooking assistant that provides:

• Ingredient Scanning: Camera-based recognition of food ingredients in your kitchen
• Recipe Suggestions: AI-generated recipe recommendations based on available ingredients
• Cooking Guidance: Real-time visual and audio coaching during the cooking process
• Shopping Lists: Automated generation and management of grocery lists
• Meal Planning: Personalized meal planning based on preferences and dietary restrictions
• Nutrition Tracking: Calorie and macronutrient information for meals

The Service is available through our Website and Mobile Apps. Some features may vary between platforms.

3. Eligibility

To use the Service, you must:

• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
• If under 18, have parental or guardian consent to use the Service
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously suspended or removed from the Service

4. Account Registration

Each person may only maintain one active account. Creating multiple accounts may result in termination of all accounts.

5.1 Free Tier

AI Make Food offers a free tier with limited features, including:

• Up to 10 recipe recommendations per month
• Basic ingredient scanning
• Limited cooking guidance

5.2 Paid Subscriptions

We offer the following subscription plans:

• Basic Plan ($9.99/month): Unlimited recipes, full ingredient scanning, basic cooking guidance, shopping lists
• Pro Plan ($19.99/month): All Basic features plus real-time visual coaching, meal planning, nutrition tracking, family sharing (up to 5 members), priority support

5.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payment is due at the start of each billing cycle
• We accept major credit cards, debit cards, and other payment methods as displayed
• All prices are in USD unless otherwise specified
• Prices are exclusive of applicable taxes, which will be added at checkout

5.4 Cancellation & Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• We may offer refunds at our discretion for exceptional circumstances

5.5 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price increase takes effect. Your continued use after the price change constitutes acceptance of the new pricing.

Your User Content must not:

• Violate any person's privacy or publicity rights

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 AI Limitations

Our AI technology, while advanced, has limitations:

• Ingredient recognition may not be 100% accurate
• Recipe suggestions are generated algorithmically and may not suit all preferences
• Cooking times and temperatures are estimates and may vary
• Nutritional information is approximate and should not replace professional dietary advice

10.3 Food Safety

You are solely responsible for:

• Verifying ingredient freshness and safety
• Following proper food handling and storage practices
• Ensuring food is cooked to safe temperatures
• Managing food allergies and dietary restrictions
• Supervising children in the kitchen

10.4 No Medical Advice

The Service does not provide medical, nutritional, or health advice. Consult qualified professionals for dietary, allergy, or health-related decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• AI MAKE FOOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT LIABLE FOR DAMAGES ARISING FROM FOODBORNE ILLNESS, ALLERGIC REACTIONS, KITCHEN ACCIDENTS, OR OTHER COOKING-RELATED INCIDENTS

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless AI Make Food, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights
• Any cooking-related incidents arising from your use of the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in Settings
• Contacting us at support@aimakefood.com

13.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended periods of inactivity
• At our sole discretion for any reason

13.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and User Content
• You may request a copy of your data before termination
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on the Service
• Sending an email to your registered email address
• Displaying a notice within the Mobile Apps

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

15.2 Arbitration Agreement

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

15.3 Class Action Waiver

YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction.

You may opt out of the arbitration agreement by sending written notice to legal@aimakefood.com within 30 days of first accepting these Terms.
